There Will Be A Hearing Today About Ted Cruz’ Natural Born Citizenship

Ted Cruz is going to have to prove he is a natural born citizen at a hearing in New Jersey today.

Here is something that has been showing up around the ‘net in that regard. It sounds right. But who knows how the question will be decided?

This is to alert you to a very serious issue that may affect you as you will soon be asked to cast your vote in the Republican primary convention. Please be advised that if you intend to cast a vote for candidate Rafael Ted Cruz for the office of president you may very well be committing a felony under US laws. The office of President and vice president of the US are the only two offices in the country that are required by the US Constitution to only be held by a “natural born citizen”

Misprision of felony
Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.

Misprision of treason
Whoever, owing allegiance to the United States and having knowledge of the commission of any treason against them, conceals and does not, as soon as may be, disclose and make known the same to the President or to some judge of the United States, or to the governor or to some judge or justice of a particular State, is guilty of misprision of treason and shall be fined under this title or imprisoned not more than seven years, or both.

Ted Cruz was born in Calgary Canada in 1970. His father was a Cuban or Canadian citizen. His mother was born in the US. The Supreme court definition of Natural born citizen is a person born on US soil to two US citizen parents. See Minor v Happersett (1875). This means that Ted Cruz cannot be a natural born citizen of the US…he was not born on US soil to two US citizen parents.

There are two types of US citizens. Natural born citizens and naturalized citizens. Ted Cruz can ONLY be a naturalized US citizen and therefore not eligible to hold the office of president or the office of vice president.

Here is the “binding precedent” from the US Supreme Court: “The Constitution does not in words say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their parents. As to this class there have been doubts, but never as to the first. For the purposes of this case, it is not necessary to solve these doubts. Minor v Happersett (1875)

In 1971, Supreme Court Justice Hugo Black, who just 4 years earlier had written the majority opinion in the case of Afroyim v. Rusk, had the following observation to make of foreign-born children of US citizens; “Although those Americans who acquire their citizenship under statutes conferring citizenship on the foreign-born children of citizens are not popularly thought of as naturalized citizens, the use of the word “naturalize” in this way has a considerable constitutional history. Congress is empowered by the Constitution to “establish an uniform Rule of Naturalization,” Art. I, 8. Anyone acquiring citizenship solely under the exercise of this power is, constitutionally speaking, a naturalized citizen.”

“A person born out of the jurisdiction of the United States can only become a citizen by being naturalized, either by treaty, as in the case of the annexation of foreign territory, or by authority of Congress…” ~ Supreme Court Justice Horace Gray (1898)

Ted Cruz is arguing that the “naturalization act of 1790” would make him a natural born citizen. Mr. Cruz neglects to tell the public that the 1790 act not only doesn’t say exactly what he claims but the act was repealed and made null and void five years later by the “naturalization act of 1795”. The 1795 act removed the term “natural born citizen” and replaced it with “citizen” and no naturalization act since has ever used the term natural born again. That’s because the congress cannot pass any laws to change the Constitution…they weren’t given that authority. The Constitution can only be changed by an amendment.

So if you intend on casting a vote for Rafael Ted Cruz for president at the RNC convention then you must consider the situation you are putting yourself in. You would be violating the Constitution and the law and could possibly be charged with committing a felony….it’s up to you.

If he is declared ineligible in New Jersey and several other States taking up the question I wonder what will happen to his delegates? these guys are inadvertently discussing the question. The critical point is made at about 2:40 into the discussion.

And one other point. Shouldn’t Constitutional scholar Cruz have known all this?

    Ann Coulter is convinced he’s not eligible. But there must be plenty of party big wigs who think otherwise, or his campaign would never have taken off. In any case, this needs to be resolved before the convention and election. Imagine the disaster if he gets elected, then the supreme court invalidates it. (imagine the disaster if this schmuck gets elected, full stop.)

    there have been several constitutional law professors have said he is not a natural born american citizen and why. also is mother was a registered voter in canada and may be an illegal alien and not a citizen.
