Pleading The 10th

You may recall my post Border Wars, where the Attorney Generals of Oklahoma and Nebraska are suing Colorado over pot legalization. What was my take? “Nebraska and Oklahoma must be run by Ijits.” Well, some Oklahoma Republicans agree with me.

Seven Oklahoma Republicans have come out in opposition to the state’s lawsuit against Colorado for legalizing marijuana.

In a Wednesday letter to Oklahoma Attorney General Scott Pruitt (R), who along with the Nebraska attorney general filed suit in December against Colorado, the group of Republicans argue the suit poses a risk to state’s 10th amendment rights.

Will the Republican Party come to its senses on the issue? One must remember that it is not called the “Stupid Party” for nothing. And I think it proves the old adage. Drugs make people stupid, especially those that don’t use them.

Funny enough the State of Georgia was pleading the 10th back in 2009. The site has a more recent post Marijuana Victory in DC is the Result of State Resistance and Nullification. The site is Tenth Amendment Center.

In the “Marijuana Victory….” article they note:

Because so many states defied federal mandates on marijuana, it put the feds in a tough spot. They could either continue to wage this failed crusade amidst immense public dissatisfaction and scrutiny, or they could give up. Rather than risk losing a great deal of credibility and exposing themselves as weak and ineffectual, they chose the surrender option instead. It is state-level resistance that directly facilitated our country’s shift in marijuana policy.

Of course, the feds will take credit for enacting this reform, but that is all spin and nothing but spin. After all, President Obama initially increased medical marijuana raids as compared to his predecessor. Federal bureaucrats don’t cede power voluntarily. No matter what spin they concoct, we must realize that state-level resistance is the key to substantial, lasting policy changes.

    The same type of people who claim to support state’s rights turn out to love them some drug war. One might think that an honest interpretation of the commerce clause indicates that adjacent states can not put up barriers to products grown in another.
