Railroaded For His Property

A while back I posted a video of Heart Surgeon Dr. David Allen discussing the value of cannabis for heart health.

What I didn’t know at the time was that the State of Mississippi tried to
railroad him on marijuana charges in order to steal his property.

Dr. David Allen is a cardiovascular surgeon who had spent his entire career saving the lives of people in his community. He’s hardly the man you would expect to be framed by a corrupt narcotics squad and rogue sheriff, but that is exactly what happened in this story.

And then this:

In October 2008 he began work in the Sacramento area at various clinics. In early 2009, he decided to open a legal medicinal marijuana clinic. He was well received by the community and his new practice flourished. That was until the Narcotics Task Force of Jackson County Mississippi headed by Lt. Curtis Spiers descended.

In what can only be described as a “setup raid” on February 19th 2009, the Task Force claimed they had seized marijuana and hashish. As proof they presented doctored photos from the internet, and claimed they had evidence against the former heart surgeon.

Followed by this:

The charges where one of each, for cultivation, possession of marijuana, as well as a charge for sale of hashish. The motive behind the cover-up, Dr. Allen’s 40-acre estate which he owned in Escatawpa, known by locals as the Blue Hole because of a large body of water which is located on the property.

The agents indicted Dr. Allen while he was in California on the trumped up charges, and extradited him in a passenger van for a week across state lines. The officers transporting him were not officers at all, but instead a private security firm with contracts to transport the accused.

Cruel and unusual punishment was perpetrated while the transport was happening. They refused to allow timely bathroom breaks, water breaks, or even the human decency to roll down a window for air. The transport agents’ verbal assaults became a normality along the way.

The combination of false accusations and the torture endured on the trip to a Mississippi jail, was almost too much for this accomplished surgeon.

Dr. Allen stated in a media interview in February 2012 by Eapen Thampyhe with www.forfeiturereform.com:

“I was in a coma for three days. I really wanted to kill myself, only through the grace of God did I make it through that.”

Here is what they were really after:

In December, Circuit Court Judge Kathy King Jackson signed an order allowing Dr. Allen to keep his property at the 13000 block of Miss. 613, that had been seized during the investigation.

Read the whole thing. And also read this.

Side note: My dad served on the USS Escatawpa in WW2.

Dad,

I will not allow these criminals to besmirch your service by tarnishing the namesake of your ship. God help me this God Damned Prohibition will not stand. They will have to kill me. Which they may. But I will fight it as long as I can draw a breath.

Your loving son,

Michael

This is similar to the Joshua Hakken drama…some libertarian pot smoker is now public enemy #1 because he “kidnapped” his children after they were taken away after an arrest for pot. I think he’s being set up to be killed by all the government agencies that are looking for him. Tragic, he would have been better off with a fancy lawyer instead of resorting to self help. Here’s the best coverage:

. If you agree that prohibition must end then please print out copies of Declaration of Rights of Cannabis Users, date and sign them and send them to ALL YOUR elected representatives AND to the United Nations. If you are REALLY passionate about this please help promote this. Thank-You, Dan Richeson

Buy stamps, envelops, print out copies of: “Declaration of Rights of Cannabis Users”, get the names and addresses of your state and federal representatives including the president and governor and, if you want, local reps. (Don’t forget the UN) Address the envelopes, Sign and date the declaration, fold it and seal it in the envelope, affix the stamps and mail them BEFORE 04-20-2013. I realize it’s a lot of hassle and some expense but prohibition is EVIL, there have been too many people spending too many years in prisons, too much paid in fines, too much property confiscated, too many innocent people killed by overzealous authorities in “marijuana raids”, all to enforce a law that is unconstitutional to begin with. Am I asking too much of you? If you were the one behind bars, paying fines, forfeiting property, mourning the loss of a loved one, what I’m asking would seem trivial, wouldn’t it?

    Mission Statement:

To bring an end to cannabis prohibition in 2013 by gathering signatory members through promotion and declaring our rights through the document, “Declaration of Rights of Cannabis Users”.
Giving prohibitionists reasonable opportunity to affect appropriate, timely and agreed upon change and, if necessary enforcing our rights in a peaceful way.
After April 20 2013 adopting a zero tolerance for acts of brutality and injustice by prohibitionists.

The laws regarding cannabis were born on the wings of lies and pampered by propaganda such that now the tightly held belief systems are going to have to reckon with the desire of all humanity to live with dignity, free from the oppressive tyranny that ignorance and bigotry have spawned!

DECLARATION OF RIGHTS OF CANNABIS USERS

Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world.

Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people.

Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law.

Whereas for too long now it has been observed that disregard and contempt for human rights has been allowed to exist in the body of politically motivated law that outlaws the possession, cultivation and use of cannabis by adults.

The signatories of this Declaration wish to live in peace in this society, have been engaged in constant communication with their elected representatives individually or as part of groups.

The actions of the government in this regards demonstrates continued contempt and disregard that we the undersigned feel that we have NO RECOURSE but to regard our government and some of our fellow citizens as hostile towards our declared rights and indifferent to the tyranny, oppression and terrorism that we have too long had to deal with.

Whereas by this declaration we provide the opportunity and impudence for representatives to engage in good faith negotiations which will lead to peaceful co-exisistance.

Whereas we the undersigned do hereby declare that IT IS OUR RIGHT to cultivate, possess and use cannabis AND that any law that says otherwise will be treated by us as the tool of tyranny.

Whereas we the undersigned in declaring our desire to realize our liberties and our desire to live in peace also recognize that the point is near where our rights and liberties will have to be defended.

Whereas we the undersigned are willing to do all we can to avoid conflict we hope that this WARNING also provides our fellow citizens and our representatives the impudence to also seek peace and understanding within our society.
